De rättsliga förutsättningarna för visselblåsarfunktionen finns i lagen (2021:890) om skydd för personer som rapporterar om missförhållanden.
The legal framework for the whistleblowing function is set out in the Act on Protection of Persons Reporting Wrongdoings (2021:890).
Visselblåsning
Du som rapporterar missförhållanden som omfattas av visselblåsarlagen (2021:890) är skyddad mot repressalier. Detta gäller endast om du kommit i kontakt med missförhållandet i ett arbetsrelaterat sammanhang, det vill säga som anställd, praktikant, jobbsökande eller liknande. Om ditt meddelande inte omfattas av visselblåsarlagen så avgör universitetet hur det istället ska hanteras.
Som rapportör förutsätts du lämna namn och kontaktuppgifter vid en rapport, men det är inget krav. Dock är uppgifterna viktiga för att avgöra om du omfattas av skyddet eller inte.
Din rapport kommer endast att hanteras av ett fåtal behörigt utsedda personer vid Uppsala universitet. Du kommer sedan att få återkoppling kring ärendet, om du valt att inte vara anonym.
Ditt meddelande till oss är en allmän handling som i regel är offentlig
När ett meddelande eller en anmälan kommer in till Uppsala universitet (UU) registreras den och får ett diarienummer. Eftersom UU är en myndighet kan ditt meddelande bli en allmän handling. Det innebär att vem som helst har rätt att begära att få ta del av den. Rätten att ta del av en allmän handling kan däremot begränsas av sekretess. UU gör alltid en så kallad sekretessbedömning som kan innebära att uppgifter som omfattas av sekretess inte lämnas ut.
Från och med den 17 december 2021 gäller en ny bestämmelse i offentlighets- och sekretesslagen som ska skydda visselblåsarens identitet inom offentlig sektor. Sekretessen gäller för uppgifter som kan avslöja den rapporterande personens identitet i ett uppföljningsärende. Med ett uppföljningsärende menas bland annat uppgifter som framkommer i ett meddelande om missförhållande som inkommit via en visselblåsarfunktion och uppgifter som består i att lämna återkoppling till den rapporterande personen.
Whistle blowing
When making a whistle blower report you are protected under the law (2021:890) on protection for people reporting on wrongdoings. This only applies if you have come into contact with the wrongdoing in a work related context, for example as an employee, intern, job seeker or similar.
You can include your name and contact details when making a report. This is not mandatory but is important for determining whether you are protected under the previously mentioned law.
Your report will only be handled by a few specifically authorized people at Uppsala University. If you have not chosen to be anonymous, you will also receive feedback on the report.
Your message to us is an official document and generally in the public domain
When a report or complaint is received by Uppsala University (UU), it is registered and given a reference number. As UU is a public authority, your message may become an official document. This means that anyone has the right to request access to it. The right to access official documents may, however, be restricted by confidentiality. UU always carries out a confidentiality assessment that may result in a decision not to disclose information that is covered by secrecy regulations.
With effect from 17 December 2021, a new provision in the Public Access to Information and Secrecy Act is intended to protect the identity of whistleblowers in the public sector. Secrecy applies to information that could reveal the identity of the person making the report in a follow-up case. The term ‘follow-up case’ refers, for example, to information revealed in a report about wrongdoings received via a whistleblowing function and information consisting of feedback to the person making the report.
